Duke lacrosse: Gaynor gets Nifong

There’s not much about DA Mike Nifong that attorney and columnist Michael Gaynor hasn’t exposed and analyzed.

Here’s the start of Gaynor’s most recent column:

When it comes to poisoning the Durham County, North Carolina jury pool, District Attorney Michael B. Nifong knows what to do and he does not want anyone trying to undo his work after he is through.
That gets it, doesn’t it?

Gaynor includes in his column a good part of the "Background Facts" portion of the motion by defense attorneys for modification of Judge Tutus’ gag order. In making their case the attorneys include a series of examples, one after another, of Nifong’s prejudicial and frequently false public statements.

You’ve probably read most, if not all of them. Still, you may find it shocking to read them in series. I did. I've a heightened sense of just how false and reckless Nifong has been.

There’s a lot more to Michael’s column. He’s always an interesting read, and especially so in this column.

Question to Michael: What are you hearing about the 60 Minutes delay until 10/1? You were one of the first to let me know of the original scheduling.

The "60 Minutes" delay is not sinister. Nifong will get an October shock instead of a September one. Judge Smith's
ungagging of potential witnesses creates more opportunities for "60." Whether the broadcast is on the 1st or the 8th, or even the 15th, is not critical. What is critical is that it be as compelling and factual as possible (and fair).

So now Nifong says the "crime' took place in 5-10 minutes instead of 30 minutes because changing the time makes Reade's alibi not as potent. He continues to change the story (with Gottlieb's help) to fit his lack of evidence.

It is pathetic that I apparently was the first to report the gagging, then somehow fitting that I posted the good news of the ungagging.

Beth Karas told Catherine Crier that the judge relaxed the gag order so it now only pertains to attorneys. Good.

Because the media basically ignored the gag order, it's not inclined to call attention to the ungagging. Shameful, but predictable. Yhe defense challenged it quietly, and they seem to be quietly savoring their success in that respect.

Despite a compelling motion to modify, Judge Titus did not modify, however.

Fortunately, his replacement, Judge Smith, did.
